The Brazilian criminal record certificate is issued online by the Federal Police, through the gov.br service, not by the consulate. What the consulate does, when a recipient in the United States requires it, is confirm the authenticity of the certificate issued by the Federal Police.

Confirmation of authenticity at the consulate

The Orlando consulate describes the service: it reassures the US recipient that the certificate is genuine. It asks for a copy of an ID document, the certificate issued on the Federal Police website and the fee, with a prior request on e-Consular. In Orlando, it can be done in person or by mail.

A US certificate, for use in Brazil

This is the reverse route. Orlando warns that criminal record certificates issued by US police authorities (police certificates) are only valid in Brazil once apostilled. The apostille is added by the Secretary of State of the state that issued the document, according to the Houston consulate.

It depends on who asks and why: a US body may ask for the Brazilian one, and a process in Brazil may ask for the American one. Read the receiving body's request carefully, since it sets the requirement.

How to pay for the confirmation

Payment follows the rules of the consulate for your jurisdiction. Miami accepts a debit card on e-Consular, with a non-refundable 4% fee, or a USPS money order; Washington and Los Angeles accept the money order only. One money order per service.

The Federal Police certificate, in practice

According to the service page on gov.br, the Federal Police certificate is free, is issued immediately and can be printed. For civil purposes it is valid for 90 days, which matters if the US agency takes a while to review your case.

The online service only issues a «nada consta» (no record) certificate, when there is no final conviction. If there is a record, the certificate is not issued online: the Federal Police requires confirmation in person at one of its units, because of people with the same name.

If the system is down, support is by email at suporte.sinic@pf.gov.br. If it is urgent and the system is down, the Federal Police says to go to one of its units, at the public service desk. For in-person service, the page estimates a wait of up to 30 minutes.

Under Article 6 of Law No. 12,037/2009, cited by the Federal Police, investigations and cases without a final judgment do not appear on a certificate issued for civil purposes: only final convictions count.

The documents for the confirmation

For the authenticity confirmation, Orlando accepts a copy of a valid Brazilian passport or the RG; a foreign national sends a copy of their valid passport. The Federal Police certificate goes as issued on the website, and the request starts on e-Consular before anything is mailed.

 A US certificate is only valid in Brazil once apostilled.
